Enforcing New Mexico’s Stringent Oil and Gas Regulations Presents Challenges

The environmental crisis in New Mexico is escalating as recent inspections by the New Mexico Environment Department revealed alarming violations by oil and gas facilities in the state. Of the 124 facilities investigated, 60% were found to be emitting volatile organic compounds, contributing to air pollution and potentially violating state rules and the federal Clean Air Act.

These violations come at a critical time as Gov. Michelle Lujan Grisham has called for a special legislative session to address public safety issues amid rising violent crime and homelessness problems. However, oil and gas industry reform, despite ongoing violations, is not being prioritized.

James Kenney, the Environment Department secretary, highlighted the challenges faced in enforcing environmental regulations due to the lack of resources and funding. The state agencies are now looking to increase permit fees paid by polluters to fund greater enforcement.

The increasing heat and drought conditions in New Mexico, exacerbated by human-induced climate change, have also led to devastating wildfires like the recent South Fork and Salt fires in Ruidoso. The aftermath of these fires has prompted support from the state government and oil companies, despite their own Clean Air Act violations.

The ongoing struggle to enforce environmental regulations and combat climate change in the face of powerful oil and gas interests underscores the urgent need for action. With the future of environmental protections at risk, the fate of New Mexico’s air quality and public health hangs in the balance.
